By placing an order on this website, you agree to these Terms. Nothing in these Terms limits or excludes any mandatory consumer rights granted under applicable law.
2. Products
We make every reasonable effort to ensure that product descriptions, specifications, photographs, compatibility information and prices are accurate.
Product photographs are provided for illustrative purposes only. Minor differences in colour, finish or appearance resulting from manufacturing processes or display settings do not affect the conformity of the products.
Should an obvious error occur in product information, pricing or availability, we reserve the right to correct such error before accepting or fulfilling the order.
3. Orders
Orders are subject to product availability. An order becomes binding once payment has been accepted and an order confirmation has been issued.
We reserve the right to refuse or cancel an order in exceptional circumstances, including obvious pricing errors, technical issues, suspected fraud or product unavailability, subject to applicable consumer protection law.
If an order is cancelled by us after payment, the customer will receive a full refund.
4. Prices and Payment
Prices are displayed in the selected currency and include VAT where applicable.
Accepted payment methods include Visa, Mastercard, Bank Transfer and Cheque (France only).
Prices may change without prior notice. Any such change will not affect orders that have already been confirmed.
5. Shipping and Delivery
Orders are generally dispatched within three (3) business days. Delivery times vary according to destination and carrier.
Estimated delivery dates are indicative only, subject to any mandatory delivery requirements under applicable law.
To the extent permitted by applicable law, we are not responsible for delays caused by carriers, customs authorities, force majeure or circumstances beyond our reasonable control.
Remote Areas and Delivery Restrictions
Certain destinations may be classified by carriers as remote, extended, difficult-to-access areas or as locations subject to specific delivery restrictions. Such classifications may depend on the country, postal code and the individual carrier's service coverage and operating criteria.
As a result, in exceptional cases, the delivery service selected at checkout may not be available for the customer's delivery address under the carrier services available to us. Due to the nature of carrier service-area restrictions, such limitations cannot always be identified automatically at checkout.
If such a restriction is identified after an order has been placed, we will contact the customer as soon as reasonably possible and work with them to find a suitable alternative delivery solution. Depending on the destination and the services available, this may include the use of a different carrier, an alternative delivery service or delivery to a collection point.
We will make every reasonable effort to offer a solution that meets the customer's expectations as closely as possible. However, due to the exceptional and sometimes unpredictable nature of carrier service-area restrictions, the use of an alternative delivery solution may result in delivery times that differ from those originally indicated at the time of ordering. The customer will be informed accordingly and, where reasonably possible, provided with a revised estimated delivery timeframe.
No change to the carrier, delivery method or delivery location will be made without the customer's prior agreement.
If none of the alternative delivery solutions offered is acceptable to the customer, the customer may decline them and request cancellation of the order. In such circumstances, all amounts paid in respect of the order, including the original delivery charges, will be refunded in full, without deduction or cancellation fee.
No additional delivery charge or change to the agreed delivery arrangements will be applied after the order has been placed without the customer's prior agreement.
6. Right of Withdrawal, Returns and Refunds
Consumers benefit from the statutory right of withdrawal where applicable under consumer protection legislation.
Details concerning eligibility, exclusions, return procedures and refund conditions are available in our Refund Policy.
Refunds are made using the original payment method unless otherwise agreed.
Nothing in these Terms limits any mandatory statutory consumer rights.
7. Legal Guarantees
Consumers benefit from all mandatory legal guarantees provided under applicable law, including where applicable:
- the legal guarantee of conformity;
- protection against hidden defects;
- any other mandatory statutory rights.
Where a product is defective or non-conforming, remedies provided by applicable law remain fully available.
8. Liability
We undertake to supply products that conform to the contract.
Nothing in these Terms excludes or limits our liability where such exclusion or limitation is prohibited by applicable law.
To the extent permitted by law, we shall not be liable for indirect or consequential damages that are not the foreseeable consequence of a breach of these Terms.
9. Retention of Title
Ownership of the goods remains with LEMA-BKR until full payment of the purchase price has been received.
The transfer of risk to the customer takes place upon delivery of the goods in accordance with applicable law.
10. Force Majeure
LEMA-BKR shall not be liable for any failure or delay in performing its obligations where such failure results from events beyond its reasonable control, including but not limited to natural disasters, fires, floods, pandemics, strikes, transport disruptions, supplier failures, governmental actions or other force majeure events.
Performance of the affected obligations shall be suspended for the duration of the event.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of France.
If you are a consumer residing in another Member State of the European Union, you also benefit from any mandatory consumer protection provisions applicable in your country of residence.
Any dispute shall be brought before the competent courts in accordance with applicable law.
